Copyright or trademark infringement...?
Being a leather crafter, and tool leather, would it be considered copyright or trademark infringement if I were to tool certain images, such as characters, or actors faces into leather? Let's just use the example of a character such as Crocodile Dundee, or an actor such as John Wayne. These images would be more like silhouettes rather than being true to nature. I guess it would be similar to the trade of caricature? These items would also not be mass produced, but what if I were to find sale in such?
Any info on this matter would be very helpful, and greatly appreciated.
Thanks in advance.
It would not likely be considered copyright infringement - you'd be making an original and most likely not a derivative work. Nor, in the case of a human, would it be trademark infringement (though it probably would be a trademark infringement for a cartoon character). However, it would be a violation of their right to publicity and/or privacy, and some states there is also a right to control the use of one's image in advertising.
